Terms of use

1. General provisions
- The owner and administrator of the web environment meiekinnisvara.ee (hereinafter the "web environment") is Itagentuur OÜ (hereinafter the "portal"), registry code 16900545, address Harju county, Tallinn, Kesklinn district, Vesivärava tn 50-301, 10152. Contact: email info@meiekinnisvara.ee.
- These terms of use govern the use of the web environment by all users (hereinafter the "user"). The terms apply regardless of whether the user has registered an account or not. To use the services in full, including publishing listings, creating a user account is required. For users without an account, services are available to a limited extent. Processing your data requires your active consent. The details of data processing are set out in our privacy policy. You can withdraw your consent to data processing partially or fully at any time by deleting your account or by contacting us through the portal or by email (info@meiekinnisvara.ee). Example: You may opt out of receiving marketing emails while keeping your account. If you withdraw consent that is essential for the account to function (e.g. use of your email address), the account will be deleted within 14 days, since the portal cannot be used without it.
- By agreeing to the terms of use and/or by using the web environment, the user confirms that they have read the terms and agree to follow them. Accepting the terms creates a binding agreement between the user and Meiekinnisvara that governs the use of the web environment, ordering of services, the rights and obligations of the parties, and payment of fees.
- The user has the right to use Meiekinnisvara services once they have created a user account. The exact terms of the service (for example publishing sale or rental listings, the usage period and fees) are determined according to the chosen service package.
- The portal has the right to set additional terms for certain parts of the web environment and to notify users of this in the relevant sections.
- The portal has the right to change the terms of use, notifying the user of the changes.
- All notices and information between the user and the portal are transmitted electronically, using the contact details provided in the terms of use or in the web environment.
- If any provision turns out to conflict with applicable law, this does not affect the validity of the other provisions, and it is replaced by the regulation provided by law.
2. Web environment service
- The portal provides users with a web environment where it is possible to share and exchange information about real estate transactions, publish sale and rental listings, and use other services that the portal offers.
- When adding a listing, the user is obliged to enter only the relevant information about the real estate object. Adding advertising to a listing is prohibited. In case of violation of such rules, the portal has the right to demand an additional fee or remove the listing from the web environment.
- All sale and rental contracts are concluded between users independently, without the participation of the portal. The portal does not participate in contracts concluded between users and is not responsible for their performance. We recommend consulting a relevant specialist when making a transaction.
3. User obligations
- 3.1 The user undertakes to:

- Enter accurate and truthful data upon registration.
- Follow the applicable terms when using the web environment.
- Ensure that all entered data and photos are accurate and do not infringe the rights of third parties.
- Pay the listing publication fee according to the current price list.
- Keep their user account data, including the password, confidential.
- Make sure that uploaded files do not contain viruses or other malware that could damage the web environment.
- 3.2 The user is prohibited from:

- Using the web environment for fraud or illegal activity.
- Sending spam or other inappropriate content.
- Publishing listings for which there is no right.
- Using the web environment in a way that may disrupt or damage it.
4. Copyright
- All materials presented in the web environment are protected by copyright and belong to the portal or are licensed for use. The portal has the right to remove any content that violates Estonian laws or the portal's rules, without prior notice.
- The user grants the portal the right to use uploaded content only for the purpose of operating the web environment and delivering direct listings. For any other commercial use, separate written permission is required.
- The user retains the copyright of all uploaded materials. The portal may use the content only to provide the service.
- The portal has the right to publish the user's listings on social media channels to promote the sale or rental of real estate.
5. Advertising
- It is possible to place advertisements in the web environment according to the price list. The portal has the right to review the advertising content and reject it if necessary if it does not meet the applicable requirements. Advertising illegal products or services is prohibited. Our portal does not use cookies to post targeted advertisements.
- Advertising must be paid for in advance.
6. Payment
- All paid services must be paid for in advance according to the price list provided on the website. Refunds are possible only if the service has not been provided or a technical error has occurred. Adding a regular listing is free.
- For invoices not paid by the due date, the portal has the right to demand interest on arrears and to use third parties to collect debts.
- The service price list and payment terms may be changed, notifying users on the website or by email. We notify users of price changes at least 30 days in advance. If the user does not agree with the new prices, they have the right to terminate the contract early.
7. Liability and compensation
- The portal is not responsible for interruptions or malfunctions in the service. We urge users to report malfunctions immediately so that all errors can be eliminated as quickly as possible. The portal is not responsible for service interruptions caused by global events (e.g. wars, natural disasters) or by the actions of third parties (e.g. internet service provider failures).
- The portal is not responsible for contracts concluded between users or for their performance.
- The user is responsible for their activity in the web environment and undertakes to compensate the portal for damages caused by violation of the terms of use.

9. Other terms
- The contract concluded upon agreeing to the terms of use is valid indefinitely. The user has the right to terminate the contract at any time.
- If a user account is inactive for 3 years, the portal may close the account.
- The portal has the right to restrict or completely prohibit the use of the web environment if the user violates the terms.
- Estonian Republic laws apply to the terms. Disputes are resolved first through negotiation, but as a last resort also in court. If the user is a resident of the European Economic Area, you also have the right to contact the European Consumer Centre Network.
